Probate

                              Guiding you through the process:

Probate follows what is typically a painful emotional loss. At the Sippel Law Firm PLLC, we have 36 years of experience in probate law and know how to ease the stress of probate by guiding the family, the Personal Representative,  and Beneficiaries through the process.

The process of probate is actually very simple:
It is designed to answer two questions:   (1)  How do we transfer clear title to assets?  and  (2) How do we make certain the bills are paid, so the heirs get their fair share, free and clear of creditor claims?
WE SEEK SOLUTIONS THAT WORK.

Most people appointed to administer the estate — the Personal Representative —  have rarely if ever probated a will and know little about the process.   Even the newly established videos relating to fiduciaries, the task can be a lot to take on.  We can guide you through all aspects of probate, including:

  • Filing the will with the Arizona probate court
  • Developing the best strategy for fairly and expeditiously probating the estate
  • Finding and collecting assets
  • Closing and opening bank accounts
  • Transferring assets from the deceased to the estate
  • Paying estate taxes if needed (most estates do not)
  • Valuing, managing, preserving and liquidating the estate
  • Locating beneficiaries
  • Hiring experts, when appropriate

Probate disputes:

Even in apparently straightforward estate cases, there are sometimes disputes between beneficiaries. Our professional courtroom presence can calm the emotionally charged process of probating a challenged will or disputed executor or judicial decision. When it is in the best interests of our client to preserve cordial familial relationships, the Sippel Law Firm is adept at mediating these disputes.   BUT!! if  there is no other feasible option,  we assertively defend our client’s beneficiary rights within the Arizona probate court.

Guardianships and Conservatorships for both Minors and for the Elderly:

Probate Court is where the needs of the young, the elderly, and the surviving family have the focused attention of the Courts. Within these types of cases, the Courts include all matters relating to Wills, Trusts, and Probate issues, Guardianships and Conservatorships for both minors and the elderly.

We focus on results at the least cost. Probate was designed to be a simple process to make sure that bills are paid, and title to properties are transferred clearly to the correct people. Even with the best of planning and advice, we have to apply for clarification to the Courts to sort out estate matters. When there is no planning, or in cases of financial exploitation, the need for insight, intensity, and follow through is mission critical. The Probate Code, and the Rules are changing, and updating your wills, your trusts, and considering less expensive alternatives should be a strong life planning choice everyone needs to make

Appointing a guardian for your Children:
Your will allows you to make decisions about the future care of your minor children. This is especially crucial if you are a single parent or in the event that both parents die in a common incident. If you have not named a guardian for your children, the court appoints one, who may make parental decisions contrary to what you would have wanted. In your will, you can also make arrangements for the care of your pets, naming a guardian to take responsibility for them.

Caring for an incapacitated adult
When devising your estate plan, the care of the most vulnerable members of your family is likely your foremost concern. At the Sippel Law Firm PLLC, we can advise you on making crucial decisions about the financial support, protection and guardianship of developmentally disabled or physically challenged adults or similarly disadvantaged children who face a precarious future if left to their own devices.  Early Planning may save Probate Court costs, legal fees, and protect the entire family.
